Also known as JCT Clause 6.5.1, Non-Negligent Insurance is one of those insurances that confuses even the professionals, so if your architect has told you to look into it and you have no idea why then look no further!
Basically if you are for example, digging a basement and you live in a mid-terrace, semi-detached house or a block of flats then your neighbours might get a bit worried about your works affecting the structure of their property – these neighbours are ‘party wall considerations’. Living in a detached property does not get you out of considering this insurance, it’s just less of an issue.
Non-Negligent Insurance will pay out if an incident occurs that no individual can be blamed for.
Non-Negligent Insurance can be quite expensive but the cost of the policy is nothing in comparison to some of the claims we see being paid in this area.
The policy lasts as long as the works are ongoing and for a maintenance period once works are complete.
