There is no previous history of subsidence or movement at either property so it is concluded that this may be occurring as a result of the works that you are doing at your property. The neighbour therefore comes to you to pay to fix any damage to his property.
Under the non-negligence party wall cover that you have taken out, this would provide cover to pay for the reparation works at the neighbours property – on the basis that no one can be at fault. The architect, surveyor and contractors are all ruled out to be negligible (it might have been due to vibrations for example) – but that still leaves the damages to be repaired – and this fall on you as the homeowner. Under this policy, you are protected and only have to pay the excess on your policy.
